By creating an account, accessing SwishEmail, or using our services, you agree to these Terms. If you do not agree, you must not use SwishEmail.

Please read these Terms carefully before using SwishEmail.

2. Account Eligibility
You must be at least 13 years old to use SwishEmail. If the laws of your country require a higher minimum age, you must meet that higher age requirement.
You are responsible for ensuring that your use of SwishEmail is lawful in your country or region.
3. Your Account
You are responsible for maintaining the confidentiality of your login details and for all activity that occurs under your account.
- You must provide accurate account information where required.
- You must not share, sell, transfer, or resell your account.
- You must notify us promptly if you believe your account has been compromised.
- You are responsible for keeping recovery information up to date.
4. The SwishEmail Service
SwishEmail provides email hosting and related services, including Webmail access, email sending and receiving, mailbox storage, mobile app access, account management features, and support services.
SwishEmail is provided as a free, privacy-focused email service with no advertising inside your mailbox.
5. Storage Limits
Free SwishEmail accounts include up to 25GB of mailbox storage, unless otherwise stated.
If your account exceeds applicable limits, we may restrict sending, receiving, or storage functionality until usage is reduced or additional options become available.
6. Acceptable Use
You agree not to use SwishEmail for unlawful, harmful, abusive, or disruptive activity. You must not use SwishEmail to:
- Send spam, unsolicited bulk email, or deceptive messages.
- Send phishing emails, scams, fraudulent content, or impersonation attempts.
- Distribute malware, viruses, ransomware, spyware, or harmful code.
- Harass, threaten, abuse, stalk, defame, or intimidate others.
- Impersonate another person, company, service, or organisation.
- Violate intellectual property rights, privacy rights, or other legal rights.
- Send, store, or distribute illegal content.
- Attempt to gain unauthorised access to accounts, systems, or networks.
- Interfere with, overload, scan, scrape, reverse engineer, or disrupt SwishEmail systems.
- Use SwishEmail to operate bot accounts, abusive automation, or high-volume sending without permission.
- Use the service in a way that damages SwishEmail’s reputation, infrastructure, deliverability, or other users.
7. Email Deliverability
We work to provide reliable email delivery, but we cannot guarantee that every message will be delivered, received, accepted, or displayed by third-party email providers.
External email systems may reject, delay, filter, quarantine, or block messages for reasons outside our control.
8. Security and Abuse Protection
We may use automated systems to detect spam, malware, phishing, abuse, suspicious login activity, and other threats.
We may temporarily or permanently restrict accounts, messages, sending ability, or access where we believe it is necessary to protect SwishEmail, users, third parties, or the wider internet.
9. User Content
You retain ownership of the content you send, receive, upload, store, or create using SwishEmail.
You grant SwishEmail the limited permission necessary to process your content for the purpose of operating the service, including sending, receiving, storing, displaying, filtering, syncing, securing, and supporting email functionality.
10. Privacy
Our handling of personal data is described in our Privacy Policy. By using SwishEmail, you acknowledge that personal data will be processed as described there.
11. No Ads
SwishEmail does not show advertisements inside your mailbox and does not use your email content for advertising profiles.
12. Service Availability
We aim to keep SwishEmail available and reliable, but the service may be interrupted, delayed, unavailable, or modified from time to time due to maintenance, upgrades, outages, security issues, abuse prevention, provider failures, or circumstances beyond our control.
We do not guarantee uninterrupted, error-free, or permanent availability of the service.
13. Account Suspension or Termination
We may suspend, restrict, or terminate your account if:
- You violate these Terms.
- You misuse the service or create security, legal, operational, or reputational risk.
- Your account is involved in spam, phishing, malware, fraud, or abusive activity.
- We are required to do so by law or valid legal process.
- The account appears abandoned, compromised, or harmful to the service.
Where practical and appropriate, we may provide notice or an opportunity to resolve the issue, but we are not required to do so where immediate action is needed.
14. Account Deletion
You may request deletion of your account by contacting support or by using account deletion tools where available. Account deletion may permanently remove your mailbox, emails, contacts, settings, and access to SwishEmail.
Some limited records may be retained for a reasonable period where necessary for security, legal compliance, fraud prevention, dispute resolution, or operational purposes, as described in our Privacy Policy.
15. Third-Party Services
SwishEmail may rely on third-party providers for functions such as hosting, transactional email delivery, analytics on public pages, security, infrastructure, and app distribution.
We are not responsible for third-party websites, services, app stores, email providers, or systems that are outside our control.
16. Legal Requests
We may disclose information where required by valid legal process or applicable law. Where appropriate, we may seek to narrow, reject, or challenge overly broad or unlawful requests.
17. Intellectual Property
SwishEmail, the SwishEmail name, branding, website, software, design, logos, and related materials are owned by Swish World Group Inc or its licensors.
You may not copy, modify, distribute, sell, or misuse SwishEmail branding, software, or materials without permission.
18. Disclaimers
SwishEmail is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, availability, security, reliability, and non-infringement.
19. Limitation of Liability
To the fullest extent permitted by law, Swish World Group Inc and its owners, directors, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, business, access, messages, or service availability.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
20. Indemnity
You agree to defend, indemnify, and hold harmless Swish World Group Inc from claims, damages, losses, liabilities, costs, and expenses arising from your misuse of SwishEmail, violation of these Terms, violation of law, or infringement of another person’s rights.
21. Changes to the Service
We may update, modify, suspend, replace, or discontinue parts of SwishEmail at any time. This includes improving, replacing, or updating Webmail and related service features.
22. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify users, such as by posting an updated version, changing the “Last updated” date, or sending notice where appropriate.
Continued use of SwishEmail after updated Terms become effective means you accept the updated Terms.
23. Governing Law
These Terms are governed by the laws of the Commonwealth of Kentucky, United States, unless applicable consumer protection laws require otherwise.
